Terms of Service

1. The agreement

These terms govern your use of vintageredtruck.com and any rental of the vintage truck (the "Truck") from Rocco Jacobs Holdings LLC (doing business as "Vintage Red Truck") ("we", "us"). By requesting dates, paying a deposit, or taking delivery of the Truck you agree to them. A separate written rental agreement may be signed at or before delivery; if it conflicts with these terms, the signed agreement controls.

2. Requests, quotes and confirmation

• A request made on the booking page is a request, not a reservation. Dates are held only once we confirm in writing and the deposit is received.
• Quotes shown online are estimates. Rental rates are fixed per calendar day. Delivery is priced from the address you give: included within 10 miles of our base, charged per mile beyond that, and quoted individually for longer distances and out-of-state transport on a covered carrier. We confirm the final price before you pay the deposit.
• We may decline any request, for example when dates, distance, site conditions or the intended use are not a fit.

3. Payment

• A deposit of 50% of the total holds your dates. It is due within 3 days of our confirmation; if it is not received by then, the dates are released.
• The balance is due before delivery, unless we agree otherwise in writing. The Truck is not delivered until the balance has cleared.
• We accept payment by credit or debit card through Stripe, PayPal, check, or wire transfer. When we confirm, we send an invoice with a secure card payment link and the details for the other methods.
• Card payments are processed by Stripe or PayPal on their secure pages. We never see or store your full card number. Their fees are included in our price.
• Checks are payable to Rocco Jacobs Holdings LLC (doing business as "Vintage Red Truck"). A check must clear before the rental date, so allow 7 to 10 business days. A returned check is charged the bank fee plus $35.
• Wire transfers: bank details are on the invoice. Any fees your bank or an intermediary bank charges are yours; the amount we receive must equal the invoice.
• Nothing is charged through this website itself. The booking page only sends us a request.
• Prices do not include sales tax where it applies, permits, venue fees or parking.

4. Cancellation, rescheduling and weather

• Cancel 14 days or more before the first rental day: the deposit is refunded in full.
• Cancel less than 14 days before: the deposit is not refunded.
• Cancel within 48 hours of delivery, or refuse delivery: the full rental fee is due.
• Rescheduling: one change of dates is free if requested at least 14 days ahead and the new dates are open.
• Weather: if severe weather makes delivery or your event unsafe, we will move your dates at no charge subject to availability, or refund the deposit if no alternative works.
• If we cancel for any reason other than your breach, you receive a full refund of everything paid, and that refund is our only obligation.

5. Delivery, placement and site access

• You are responsible for the site: a route a truck and trailer can use, firm level ground, and any permission needed from the property owner, venue, HOA, city or event organizer. Permits are yours to obtain.
• Tell us about gates, soft ground, low branches, tight turns and parking limits when you book. If we cannot place the Truck safely on arrival, we will place it as close as we reasonably can; if that is not possible the rental is treated as a late cancellation.
• Once placed, the Truck is not moved except by us. Waiting time beyond 30 minutes at delivery or pickup, and any return trip caused by the site not being ready, may be charged at our then-current hourly rate.

6. Using the Truck

The Truck is rented as a stationary display and photo prop. Unless we are driving it, it must stay where we place it. During the rental you agree that:

• Only our driver operates the Truck. It is never driven by you, your guests or your crew.
• People may sit in the bed or on the tailgate only while the Truck is stationary. In a parade or moving shot, riders sit down, stay inside the bed, and the Truck moves at walking pace with our driver. Local rules and the event organizer's rider policy apply.
• Nothing is attached to the paint with adhesive, tape, magnets, screws or clamps. Decorations tie to the wooden stake rails or sit loose in the bed.
• No open flame, fireworks, smoke machines aimed at the Truck, glitter, confetti, paint, chalk, food or drink on the paint, or anything that drips or stains.
• Load in the bed stays under 500 pounds, evenly spread, with nothing hanging over the sides.
• No smoking or vaping in the cab; no alcohol in or on the Truck.
• Children are supervised at all times around and on the Truck. Shoes stay off painted surfaces.
• The Truck is not used to tow, haul cargo, or transport people on public roads except by us.
• You will not sell, sublet or lend the Truck to anyone else.

7. Damage, loss and cleaning

• You are responsible for the Truck from the moment we place it until we collect it. Damage beyond normal wear that occurs in that period, whether caused by you, your guests, your crew, vendors or the public at your event, is charged at the actual cost of repair, plus the daily rate for any days the Truck is out of service.
• We photograph the Truck at delivery and pickup to document its condition.
• Excessive dirt, sap, stains or debris are charged a cleaning fee at cost.
• Tell us about any damage immediately rather than at pickup.

8. Insurance, risk and liability

• We insure the Truck while it is in transit and under our control. Our insurance does not cover your guests, your property or your event.
• You use the Truck at your own risk. A vintage vehicle has sharp edges, hot surfaces after driving, and a high tailgate. You accept these risks for yourself and for the people you allow near it.
• To the fullest extent Florida law allows, our total liability for anything arising from a rental or this website is limited to the amount you paid us for that rental, and we are not liable for lost profits, lost images, missed events or other indirect or consequential losses.
• You agree to defend, indemnify and hold us harmless from claims, injuries, damages and costs (including reasonable attorney's fees) arising from your use of the Truck or the conduct of people at your event, except to the extent caused by our negligence.
• Productions and larger events may ask for a certificate of insurance or to be named additional insured. Ask when you book; a fee may apply.

9. Photos and content

• You own the photographs and footage you create. We claim no rights in your work.
• The Truck may appear in photos we take at public events or that you choose to share with us. We will ask before using an image that identifies you or your clients in our marketing.
• The text, illustrations and design of this website belong to us. You may not copy them for another business.

10. Using this website

• Booking requests must be genuine and made by an adult. Do not submit false information, bulk or automated requests, or attempt to access the administration area.
• We try to keep availability and prices accurate, but the calendar is not a guarantee until we confirm your dates.
• The site is provided "as is" and may be unavailable at times.

11. Governing law and disputes

These terms are governed by the laws of the State of Florida. Any dispute will be brought in the state or federal courts located in Hillsborough County, Florida, and you consent to that venue. Before filing, both sides agree to try in good faith to resolve the matter by direct discussion.

12. General

• If any part of these terms is unenforceable, the rest still applies.
• Our failure to enforce a term once is not a waiver of it.
• These terms, our Privacy Policy and any signed rental agreement are the entire agreement between us about the Truck and this website.
• We may update these terms; the date at the top shows the current version. Changes apply to requests made after they are posted.
